Welcome to Skill Sync Pty Ltd trading as Skill Sync Education and Training ("Skill Sync", "we", "our", or "us").

These Terms and Conditions ("Terms") govern your engagement with Skill Sync for Recognition of Prior Learning ("RPL") facilitation services via partnered Registered Training Organisations ("RTO"). By accessing or using these services, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

Skill Sync provides education consultancy services, assisting Clients in converting their real-world experience and skills into nationally recognised qualifications through accredited RTOs.

1. Definitions

• Client: Any individual engaging Skill Sync for RPL facilitation. • Services: Assistance with RPL assessment submission, skills mapping, document guidance, liaison with RTOs, and related support. • Third-Party Provider: Any RTO, verification agency, or service provider engaged to deliver or facilitate the RPL services.

2. Scope of Services

• RPL Guidance & Skills Assessment – Assist clients in determining their eligibility and mapping prior experience to relevant competency units. This process is conducted by Skill Sync's in-house consultants, who carry out detailed interviews, review resumes, references, VET transcripts, and any other supporting documentation required by the partnered RTO for the purpose of assessing qualification eligibility. • Application & Submission Support – Provide comprehensive support to clients in the preparation and submission of RPL applications to the partnered RTO. Coordinate and facilitate direct communication between students and the respective RTO or RTO trainers to ensure a smooth RPL process, including interviews, evidence submission, and Kit (Knowledge, Information, and Tools) guidance, in accordance with RTO requirements. • Liaison with RTOs – Liaise with RTOs regarding assessment requirements, feedback, and results in a timely and professional manner to ensure effective coordination and prompt updates to students. • Ongoing Assistance – Providing support through the RPL process until certification is issued. Skill Sync Pty Ltd is not a Registered Training Organisation (RTO) and does not issue qualifications. All Recognition of Prior Learning (RPL) assessments, outcomes, and qualification certificates are issued directly by the partnered RTO. Should clients require the physical posting of qualification certificates, a separate request must be submitted to Skill Sync. This service may incur a handling and postage fee of $20, payable before dispatch. The scope of Skill Sync's services concludes upon the issuance of the qualification certificate by the partnered RTO and the clearance of all associated payments. Any further assistance, advisory work, or post-certification support falls outside the standard service scope. It will require a new engagement agreement, which may attract additional fees depending on the nature of the requested service.

3. Accuracy of Information

The Client must ensure that all personal, academic, and financial information, as well as any supporting documentation provided to Skill Sync Pty Ltd, is true, complete, and accurate to the best of their knowledge. As part of the Recognition of Prior Learning (RPL) process, Skill Sync may collect and review various forms of evidence to support competency assessment, including but not limited to photos, videos, work samples, sketches, graphs, project documentation, employment records, tax returns, and other relevant materials. Such evidence is gathered solely to verify experience and align it with the qualification requirements mandated by the partnering RTO. Skill Sync shall not be held liable for any delays, rejections, or adverse outcomes resulting from false, misleading, or incomplete information or documentation supplied by the Client.

4. Fees and Payment

• All applicable service fees are specified in the Client's quotation. • The Client must adhere to the payment terms and schedules as agreed with Skill Sync Pty Ltd, or as stipulated by the relevant institution. No application, lodgement, or related service shall proceed until all required payments have been received in full. • All payments must be made within the payment period specified on the issued invoice. Failure to comply with the due date may result in delays, suspension of services, or cancellation of the application process at Skill Sync's discretion. • By engaging Skill Sync's Services, the Client acknowledges receipt of the Fee Disclosure Statement and confirms their understanding of all fees payable, whether to Skill Sync directly or to the institution.

5. Third-Party Providers

Skill Sync may engage RTOs and other partners to deliver RPL services. • Skill Sync does not control or guarantee the outcomes of assessments conducted by RTOs. • All decisions, assessments, and certificates issued are subject to the RTO's own policies and standards.

6. Intellectual Property

All content on our website, marketing materials and documents are owned or licensed by Skill Sync. You may not reproduce, distribute or commercialise our materials without our written permission.

7. Limitation of Liability

Skill Sync shall not be liable for: • The rejection or refusal of any application by an educational institution, RTO, government authority, or other third-party body. • Any changes to immigration, education, or regulatory policies that may impact the application of the RPL process. • Any losses, damages, or adverse outcomes resulting from decisions or actions outside the reasonable control of Skill Sync. To the maximum extent permitted by law, Skill Sync Pty Ltd's liability for any loss, damage, or claim arising out of or in connection with the provision of its services shall be strictly limited to the fees paid by the Client for the specific service giving rise to the claim, or as otherwise stated in the Client's quotation. Skill Sync endeavours to partner only with Registered Training Organisations (RTOs) and education providers that are compliant with relevant regulatory standards. However, Skill Sync has no control over the ongoing operations, compliance status, or future viability of any partnered institution. Accordingly, any adverse impacts arising from an institution's operational changes, suspension, or closure fall outside Skill Sync's responsibility and shall not give rise to any claim or liability against the company.

8. Force Majeure

Skill Sync Pty Ltd shall not be held liable for any delay, interruption, or failure to perform its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, labour strikes, telecommunications or IT outages, or any other event that may reasonably be deemed a Force Majeure event.

9. Cancellation & Refunds

Cancellations and refunds are subject to Skill Sync's Refund Policy.

10. Data Protection & Privacy

All personal information collected, stored, and processed by Skill Sync is managed in accordance with our Privacy Policy and the provisions of the Privacy Act 1988 (Cth).

11. Governing Law

These Terms are governed by the laws of Victoria, Australia, and any disputes arising in connection with them will be subject to the exclusive jurisdiction of the courts of Victoria.

12. Client Service Agreement

A comprehensive quotation, detailing the scope of services, applicable fees, and specific terms of engagement, shall be issued to the Client by the Skill Sync team before the commencement of any services. The Client must accept the quotation before Skill Sync undertakes any application processing, advisory, or related service activities.

Privacy Policy

Skill Sync Pty Ltd is committed to protecting the privacy of all personal information collected in connection with the provision of its services. All personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

4. Security

Skill Sync Pty Ltd implements secure digital storage systems and restricted access controls to protect personal information from unauthorised access, misuse, disclosure, or loss. All security measures are maintained in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

5. Retention

We retain client records and personal information for a period of no less than seven (7) years after the end of the engagement, unless a longer retention period is required by law. You may request deletion of personal data, subject to legal and contractual obligations.

6. Cookies

Skill Sync Pty Ltd may use cookies and similar technologies on its website to enhance user experience, analyse site usage, and personalise content. Users may manage their cookie preferences through the website's cookie banner or via their browser settings. Continued use of the website constitutes acceptance of the use of cookies in accordance with this policy.

Under the Privacy Act 1988 (Cth), Clients have the right to access and request correction of their personal information held by Skill Sync Pty Ltd. Skill Sync will respond to such requests in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

8. Updates

Skill Sync may periodically update this Privacy Policy to reflect changes in legal, regulatory, or operational requirements. The latest version of the Policy will be made available on our website, and continued use of our services constitutes acceptance of any such updates.

Refund Policy

Purpose: The purpose of this Refund Policy is to establish a clear, fair, and transparent framework for the handling of refunds for clients engaging the services of Skill Sync, ensuring compliance with applicable laws and contractual obligations.

1. Service Fees

• All service fees are non-refundable once the RPL application has been submitted to the RTO. • Refunds may only be considered within the RTO's prescribed grace or cooling-off period. • Once the RPL assessment has been completed and results issued, all fees are final and non-refundable.

2. Third-Party Fees

• Fees for assessments, verification, or materials charged by RTOs or other third parties are subject to their own refund policies.

3. Processing

• Approved refunds will be processed within 21 business days. • Refunds will be made to the original payer unless otherwise agreed. • Bank or transaction fees may be deducted.

4. Exceptional Circumstances

• Refunds outside this policy may be considered at Skill Sync's discretion, for cases such as medical emergencies or unforeseen events, but do not create a binding obligation.

Complaints & Appeals

Skill Sync Pty Ltd is committed to providing high-quality RPL facilitation services.

If a Client has a complaint regarding our services or wishes to appeal a decision, they are encouraged to follow the procedures outlined below to ensure their concern is addressed in a fair, timely, and transparent manner.

1. Submit Your Complaint

Clients should email advisory@skillsync.com.au with: • Full name and contact information • Nature and details of the complaint • Any supporting evidence

2. Acknowledgment

Complaints will be acknowledged within 3–7 business days, confirming that the matter is under review.

3. Investigation

Skill Sync will investigate and aim to provide a response within 15 business days. Delays will include an expected response date.

4. Internal Review

If dissatisfied, Clients may request an internal review by emailing connect@skillsync.com.au within 10 business days of the decision.

5. Confidentiality

All complaints are confidential, and Clients will not face reprisal or disadvantage for lodging a complaint.

6. Record-Keeping

Records of complaints, investigations, resolutions, and corrective actions are retained for 7 years.
